In a world overloaded with hashtags and viral headlines, the call for justice in Palestine goes far beyond online awareness. True accountability means consequences—and in 2025, the fight for justice has moved into some of the highest legal institutions in the world: the International Criminal Court (ICC) and the International Court of Justice (ICJ).

While the bombs have fallen and the suffering continues, legal efforts are underway that could reshape global conversations about war crimes, occupation, and impunity. Let’s break down what’s happening—and why it matters.

 

ICJ: Genocide Case at The Hague

In early 2024, South Africa filed a case at the International Court of Justice accusing Israel of committing genocide against Palestinians in Gaza. The ICJ—the UN’s top court—quickly took it seriously, issuing provisional measures demanding Israel take steps to prevent further civilian harm.

By 2025, more countries had joined or supported the case, including Ireland, Brazil, and others. The hearings included footage, testimonies, and detailed accounts of the humanitarian disaster in Gaza: entire families erased, infrastructure destroyed, and a population on the brink of famine.

The ICJ’s focus is on state responsibility—whether the State of Israel, as a government, is committing acts that qualify as genocide under international law. A final ruling could take years, but its interim measures already carry legal weight. If Israel fails to comply, it raises serious questions for states that continue to support it.

 

ICC: Prosecuting War Crimes and Individuals

The International Criminal Court works differently. It prosecutes individuals—commanders, political leaders, or militants—for war crimes, crimes against humanity, and genocide.

The ICC began investigating the situation in Palestine years ago, but since October 2023, pressure has grown rapidly for action. By 2025, the Court has received formal evidence packages from multiple international legal groups documenting:

  • Deliberate targeting of civilians

  • Use of starvation as a weapon

  • Attacks on hospitals, schools, and aid workers
